Criminal Laws in North Carolina
Crimes in North Carolina fall into one of two categories: misdemeanors and felonies. Although misdemeanors are less serious than felonies, they can still lead to a jail sentence, fines, and other severe consequences.
The four types of misdemeanors in NC include:
- Class A1 misdemeanors – Maximum 150-day jail sentence and a fine determined by the court
- Class 1 misdemeanors – Maximum 120-day jail term and a fine determined by the court
- Class 2 misdemeanors – Maximum 60-day jail sentence and a fine no more than $1,000
- Class 3 misdemeanors – Maximum 20-day jail term and a fine no more than $200
Prior convictions play a role in determining a sentence. No prior convictions fall under Level 1, one to four prior convictions fall under Level 2, and five or more prior convictions fall under Level 3. There are three types of punishments for misdemeanors: active punishment (jail), intermediate punishment (house arrest), or community punishment (probation and/or community service).
On the other hand, felonies carry longer prison sentences. Furthermore, a conviction also means losing your gun rights and voting rights.
The following is every class of felony:
- Class A felony – Life imprisonment with or without parole or the death penalty
- Class B1 felony – A prison term from 144 months to life without parole
- Class B2 felony – A prison sentence from 94 to 393 months
- Class C felony – A prison term from 44 to 182 months
- Class D felony – A prison sentence from 38 to 160 months
- Class E felony – A prison sentence from 15 to 63 months
- Class F felony – A prison term from 10 to 41 months
- Class G felony – A prison sentence from eight (8) to 31 months
- Class H felony – A prison term from four (4) to 25 months
- Class I felony – A prison sentence from three (3) to 12 months
Just like misdemeanors, a prison sentence for a felony is decided based on prior conviction levels. However, each previous conviction is based on points. For instance, A previous Class BI felony conviction is nine points, while a previous Class B2 felony conviction is six points. When you add all the points, the total amount will place you in a prior record level ranging from Level I to Level VI. The court will also consider aggravating and mitigating circumstances.
